Terms of Service — Ztudy

1. Introduction & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Bright Techno Solutions ("Company", "we", "us", or "our"), governing your access to and use of the Ztudy platform (the "Service"). By registering for an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use this Service. If you are registering on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration & Security

  • You must provide accurate, current, and complete information during registration.
  • You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You must notify us immediately at support@brighttechnosolutions.com if you suspect any unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Free Demo & Subscription Plans

  • Demo Period: Upon registration, you receive a 30-day free demo with limited features and usage quotas. The demo is strictly for evaluation purposes and should not be used for production-critical or commercial data.
  • Paid Plans: To continue using the Service after the demo period, you must subscribe to a paid plan. Plan details, pricing, and feature comparisons are available on our website or upon request.
  • Billing: All paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payments are non-refundable except as explicitly stated in our Refund Policy or required by applicable law.
  • Upgrades & Downgrades: You may change your plan at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle.

5. Data Ownership & Retention

  • You retain full ownership of all data, content, and records you upload to or create within the Service ("Your Data").
  • We do not claim any intellectual property rights over Your Data.
  • During the demo period, Your Data is stored securely. If you do not upgrade to a paid plan within 15 days after the demo expires, Your Data may be permanently deleted without further notice.
  • For paid subscribers, Your Data is retained for the duration of the active subscription plus a 30-day grace period after cancellation, during which you may export Your Data.

6. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Upload or transmit malicious code, viruses, or any content that could harm the Service or other users.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
  • Interfere with or disrupt the integrity, security, or performance of the Service or its infrastructure.
  • Use automated tools (bots, scrapers, crawlers) to access the Service without prior written consent.
  • Resell, sublicense, or redistribute access to the Service to any third party.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

7. Intellectual Property

The Service, including all software, source code, design, user interface, graphics, logos, trademarks, and documentation, is the exclusive property of Bright Techno Solutions and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during your active subscription. Unauthorized reproduction, modification, or distribution of any part of the Service is strictly prohibited.

8. Service Availability & Support

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted or error-free access. Scheduled maintenance windows will be communicated in advance where possible.
  • Technical support is available via email at support@brighttechnosolutions.com during business hours (Monday–Saturday, 10:00 AM – 7:00 PM IST).
  • We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable notice to active subscribers.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Bright Techno Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bright Techno Solutions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

  • By You: You may cancel your account at any time by contacting us at support@brighttechnosolutions.com. Cancellation takes effect at the end of the current billing period.
  • By Us: We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate any provision of these Terms, engage in fraudulent activity, or pose a security risk to the Service or its users.
  • Upon termination, your right to access the Service ceases immediately, and we may delete Your Data after the applicable grace period.

12. Modifications to These Terms

We may revise these Terms at any time by posting the updated version on the platform. Material changes will be communicated via email or in-app notification at least 15 days in advance. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

1. Introduction

Bright Techno Solutions ("Company", "we", "us", or "our") operates the Ztudy platform (the "Service"). This Privacy Policy explains how we collect, use, store, disclose, and protect your personal information when you use our Service. We are committed to safeguarding your privacy in compliance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act), and other applicable data protection regulations.

  • Account Information: Name, email address, phone number, institute name, and role/designation provided during registration.
  • Institutional Data: Student records, staff details, fee records, attendance data, academic information, and any other data you input into the platform as part of your institute management activities.
  • Usage Data: Log data such as IP address, browser type, device information, pages visited, features used, session duration, and timestamps. This data is collected automatically to help us improve the Service.
  • Communication Data: Records of correspondence when you contact our support team, submit feedback, or participate in surveys.
  • Payment Information: Billing address and transaction details when you subscribe to a paid plan. We do not directly store full credit/debit card numbers; payment processing is handled by PCI-DSS compliant third-party payment gateways.

3. How We Use Your Information

We use the collected information for the following purposes:

  • Service Delivery: To create and manage your account, set up your institute workspace, and provide the core features of the platform.
  • Communication: To send you transactional emails (account setup, password resets, security alerts), product updates, and service announcements. You may opt out of non-essential communications at any time.
  • Support: To respond to your enquiries, troubleshoot issues, and provide technical assistance.
  • Improvement: To analyze usage patterns, diagnose technical problems, and enhance the performance, security, and user experience of the Service.
  • Legal Compliance: To comply with applicable laws, regulations, and legal processes, and to enforce our Terms of Service.

4. Data Storage & Security

  • Your data is stored on secure servers located in India.
  • We implement industry-standard security measures including encryption at rest (AES-256) and in transit (TLS 1.2+), access controls, regular security audits, and automated backups.
  • Sensitive credentials (such as SMTP passwords and API keys) are encrypted using AES-256-CBC before being stored in the database.
  • Despite our best efforts, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security, but we continually review and improve our safeguards.

5. Data Sharing & Disclosure

We do not sell, rent, or trade your personal data. We may share your information only in the following limited circumstances:

  • Demo Accounts: Data from expired demo accounts is retained for 15 days after expiration, after which it may be permanently deleted.
  • Cancelled Accounts: Data from cancelled paid subscriptions is retained for 30 days after cancellation to allow for data export, after which it may be permanently deleted.
  • Legal Hold: We may retain certain data for longer periods where required by law or for legitimate business purposes (e.g., fraud prevention, dispute resolution).

7. Cookies & Tracking Technologies

Ztudy uses browser localStorage (not traditional HTTP cookies) for session management and user preferences. We do not use third-party advertising cookies or cross-site tracking technologies. No data is shared with advertising networks.

8. Children's Privacy

The Service is designed for use by educational institutions and is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13 without verifiable parental or institutional consent. If you believe that a child under 13 has provided us with personal data without appropriate consent, please contact us at support@brighttechnosolutions.com and we will promptly delete the information.

9. Your Rights

Under applicable data protection laws, you have the following rights regarding your personal data:

  • Right to Access: Request a copy of the personal data we hold about you.
